Court upholds SLMC member's suspension Colombo District Court Additional District Judge l.S. Abeygunaratne has upheld the power of the Sri Lanka Muslim Congress leader to suspend members from its membership. Delivering the judgement in the case filed by Nazir Ahamed Zainulabeen against the SLMC Leader Minister Rauf Hakeem and 21 others, for the suspension of his SLMC membership. The Judge said: "On perusal of the plaint, filed by the plaintiff, it is proved in respect of a purchase of a property for the Muslim Congress where a misconduct has occurred. By the plaint the plaintiff has stated that he has no-connection to the said property transaction and he is an innocent person but by his own document tendered to the court and from the plaint, it has proved that he has connection to the property transaction where his name has transpired. "On the matters set out in the plaint, it is clear that a situation has arisen to the leader, to exercise his rights to suspend the plaintiff from the membership. I hold that by suspending, the decision made by the leader, the court is vesting the powers conferred by the Constitution to the leader. If the leader of the party suspend the membership wrongly in that event the aggrieved party in terms of the Constitution can appeal to the High Command," the judgement said. |
