Enjoining Order issued in trade mark case

Commercial High Court Judge E.A.G.R. Amarasekera extended an enjoining order issued until January 15, 2013 is respect of an application by Senior Counsel Ian Fernando who appeared for the complainant in a case in which Adrian Joseph Croos Machado of Thimbirigasyaya Road, Colombo sought an injunction against the defendant Atlas Paints and Coatings (Pvt) Limited, Grandpass Road, Colombo. The Counsel submitted to court that the defendant Atlas Paints Coating (Pvt) Limited using the three trade marks owned by his clients under registration number 150368-150386 and 150387 which have a similar get up to that of his client's trade marks.

Senior Counsel Anoma Goonethilaka, who appeared for the defendant moved court for a date to file objections and answers on the next date.

Senior Attorney Ian Fernando appeared for the complaints with Attorney Saman Liyanage instructed by S. Bagidaram.

The case will be called again on January 15, 2013.
