Qazi judicial system should be reviewed and scrutinized
The functioning of the Quazi Courts in Sri Lanka should be looked at
by the Attorney General and the Islamic Sharia Council of Sri Lanka I
have noticed there are many divorce cases among Muslims being mishandled
by some quazies and proper justice is not delivered particularly to
women.
In most cases where women are concerned, they are discriminated or
justice is denied and they suffer without maintenance being given to
them and the children.
In the Quazi Courts, unlike in the District Courts when a husband
seeks a divorce from a wife immediately, the quazi decides to separate
the family without making any effort to unite the family or reconcile
the husband and wife giving no thought to the children. As I understand
there are ample discrepancies and injustices caused mainly to women in
divorce and maintenance cases in the Quazi Courts in Sri Lanka.
Hence, I earnestly draw the attention of the of Attorney General’s
Department and the Sharia Council of Sri Lanka to review and scrutinise
the Muslim Divorce Act and find a way to deliver fair judgement to the
Muslim women who seek justice from the Quazi Courts.
